BC Supreme Court decision, November 25, 2009 ...
Mr Justice Kelleher issued his decision on November 25, 2009 which stated, among other things, that the properties of the four parishes could not be used by ANiC congregations.

The complex decision ruled that:
Bishop Ingham did not have any legal or canonical authority to terminate the appointment of the trustees and wardens of the ANiC Vancouver-area churches.
A bequest of $2+ million dollars left to the Church of the Good Shepherd was awarded to the ANiC congregation for use in their ministry because the Diocese of New Westminster, with no significant population of Chinese Canadians, could not fulfill the terms of the bequest.
The duly elected trustees of those parishes control the properties, but they must exercise their duties in accordance with the act, constitution, canons, rules and regulations of the diocese. Therefore, the judge said the properties may not be used by ANiC congregations.

The case had been heard in the BC Supreme Court beginning 25 May 2009.

In August 2008, the Diocese of New Westminster purportedly fired the duly elected trustees of four ANiC parishes in the Greater Vancouver area and then attempted to seize control of the bank accounts belonging to two of those parishes, which resulted in the accounts being frozen. In order to fulfill their fiduciary responsibilities, the wardens and trustees of the four ANiC parishes asked the court for clarification of their responsibilities in light of the purported termination by the bishop.

The four parishes affected were:
St John’s Shaughnessy (Vancouver)
St Matthew’s (Abbotsford)
St Matthias & St Luke (Vancouver)
Church of the Good Shepherd (Vancouver)
