On 14 January 2011, the four ANiC parishes filed an application for leave to appeal the BC Court of Appeal decision to the Supreme Court of Canada. The parishes are asking the Supreme Court to hear their appeal of the earlier decision which removed their right to use their church buildings and awarded church properties to the Anglican Church of Canada.

On November 15, 2010, the BC Court of Appeal released its decision dismissing the appeals and upholding the original decision by Mr Justice Kelleher, while correcting many points of law in that original decision.
Both the ANiC churches and the Diocese of New Westminster appealed aspects of this decision and the case was heard in the BC Court of Appeal on 13-16 September 2010. The decision by the BC Court of Appeal panel of judges – Madam Justice Nicole Garson, Mr Justice P D Lowry and Madam Justice Mary Newbury – dismissed all appeals.
